Conditions of Use for annals.org

  1. General: These terms of use govern your access to, and use of, annals.org and its mobile applications. Any use of annals.org and its mobile applications shall constitute acceptance of these Terms of Use.
  2. Trademarks & Copyright: American College of Physicians' trademarks, service marks and trade names, and copyrighted material are valuable assets of the American College of Physicians. Except for the limited right to use, as expressly permitted under these Terms of Use, no other rights of any kind are granted. Unless otherwise indicated, the content available through annals.org and its mobile applications is protected by copyright. The person using annals.org and its mobile applications may reproduce or store copies of articles comprising the journal provided that the articles are used only for their personal, non-commercial use. Any uses and or copies of this Journal in whole or in part must include the customary bibliographic citation, including author attribution, date, article title, Annals of Internal Medicine, and the URL http://annals.org/ and MUST include a copy of the copyright notice, "Copyright © American College of Physicians.  Used with permission ". User may only use the copyrighted material in the form presented by ACP and ACP's copyrighted material may not be altered or varied, nor may any derivative works be produced based on the copyrighted materials.
  3. Permissions: Permissions can be requested directly from each individual journal article page.  Just click the "Get Permissions" link in the content toolbar, located in the horizontal bar across the top of the article title.  Permissions can also be obtained from the Copyright Clearance Center (www.copyright.com).   
  4. Photocopies, Course-packs, and Educational Use:  Uses beyond that allowed by the "Fair Use" limitations (sections 107 and 108) of the U.S. Copyright law or applicable international law require permission through the Copyright Clearance Center (www.copyright.com). The fee code for users of the Transactional Reporting Service appears in each abstract and full-text article. 
  5. Reprints: For commercial domestic reprints, please contact reprints@acponline.org.  For commercial international reprints, please contact Content Ed Net (www.contentednet.com/).
  6. Login Security: Sharing login information for the services is strictly prohibited.
  7. Linking: The American College of Physicians encourages and permits links to annals.org for educational purposes. The linking should not suggest that the American College of Physicians promotes or endorses any causes, ideas, Web sites, products, or services and no use of content from annals.org for commercial purposes is permitted or no use that in any way is unlawful or harmful to any other person or entity is permitted. We reserve the right to request removal of any link.
  8. Web Site Modifications and Availability: The American College of Physicians will make reasonable efforts to keep annals.org and its mobile applications available twenty-four hours a day, seven days a week. However, owing to technical failures, routine maintenance, or other unforeseen circumstances, availability may be limited and the American College of Physicians will not be responsible for the non-availability of annals.org and its mobile applications. The American College of Physicians reserves the right to modify, suspend, discontinue, or restrict access to, all or any part of annals.org or its mobile applications at any time.
  9. Offline Browsers: In order for us to provide reliable, continuous, and timely access to annals.org and its mobile applications for all users, we require that you configure your offline browser to request no more than one page per minute. Be aware that non-compliance with this rule will result in your access to Annals being blocked until you contact us and resolve the problem. If you repeatedly break this rule, you will be permanently blocked from the site.
  10. Disclaimer of Warranties: In no event shall American College of Physicians or Silverchair be liable for any special, incidental, indirect, or consequential damages of any kind arising out of or in connection with the use of the articles or other material derived from the Annals, whether or not advised of the possibility of damage, and on any theory of liability. The Annals are provided "as is" without warranty of any kind, either expressed or implied, including, but not limited to, the implied warranties of merchantability, fitness for a particular purpose, or non-infringement. Descriptions of, or references to, products or publications does not imply endorsement of that product or publication. There is no guarantee that the information contained in the online version of the Annals is identical to the print version and neither the American College of Physicians or Silverchair has any duty to update the information contained on the online version to correct errors or otherwise.
  11. Modifications of Terms of Use: The American College of Physicians reserves the right to modify these Terms of Use at any time. Any such modification will be posted and the continued use of the annals.org and its mobile applications after any such posting shall constitute acceptance of the Terms of Use as modified.
  12. Choice of Law and Forum: Your access and use of the Services, these Terms of Use, and all actions contemplated by these Terms of Use, shall be governed by the laws of the United States of America and the Commonwealth of Pennsylvania and any controversy arising out of or relating to the Use or Terms of Use hereunder, shall be settled in the Pennsylvania courts and all parties shall submit to the jurisdiction of such courts.
