Conditions of Use

General: These Conditions of Use govern your access to, and use of Annals of Internal Medicine website and accounts used to access Annals.org, its mobile applications, and its related services. Such services include, but are not limited to, content on Annals.org, alerts, and pay-per-view article viewing. Any use of Annals.org, its mobile applications, and its services shall constitute acceptance of these Conditions of Use.

Trademarks: Annals of Internal Medicine® and American College of Physicians® are registered trademarks of the American College of Physicians (ACP). Any use of ACP trademarks in connection with the sale, distribution, or advertising of any goods or services, unless you receive express written consent from ACP.

Copyright: Unless otherwise indicated, the content available through Annals.org, its mobile applications, and its services is protected by copyright and may be used only in accordance with copyright and other applicable law. Content available through Annals.org, its mobile applications, and its services is for personal noncommercial use. ACP's copyrighted material may not be altered or varied, nor may any derivative works be produced based on the copyrighted materials, unless express written consent is obtained from ACP.

Permissions: Permissions can be requested directly from each individual journal article page. Just click the "© Permissions" link in the content toolbar, located in the far right column across from the article title. Permissions can also be obtained from the Copyright Clearance Center (www.copyright.com). 

Photocopies, Course-packs, and Educational Use: Uses beyond that allowed by the "Fair Use" limitations (sections 107 and 108) of the U.S. Copyright law or applicable international law require permission through the Copyright Clearance Center (www.copyright.com). The fee code for users of the Transactional Reporting Service appears in each abstract and full-text article.  Institutional site license subscribers may use a reasonable portion of Annals of Internal Medicine for use in instructions for specific courses of instruction offered by their institution.  For more information on site licensing, click here.

Privacy: All information collected by ACP, the Publisher of Annals.org, is governed by the College's Privacy Policy, found at http://annals.org/aim/pages/privacy-policy.

Personal Login Security: Sharing login information for Annals.org, its mobile applications, and its services is strictly prohibited. Where registration is involved for the use of a service, you agree to provide valid and truthful information. You must contact Annals immediately if you become aware of or believe there is or may have been any unauthorized use of your Personal Login Information, or otherwise wish to deactivate your Personal Login Information due to security concerns.

Linking: ACP encourages and permits links to Annals.org for educational purposes. The linking should not suggest that ACP or Annals promotes or endorses any causes, ideas, Web sites, products, or services. No use of content from Annals.org for commercial purposes is permitted, and no use that in any way is unlawful or harmful to any other person or entity is permitted. We reserve the right to request removal of any link. 

Web Site Modifications and Availability: ACP will make reasonable efforts to keep Annals.org, its mobile applications, and its services available 24 hours a day, 7 days a week. However, owing to technical failures, routine maintenance, or other unforeseen circumstances, availability may be limited and the ACP will not be responsible for the non-availability of Annals.org, its mobile applications, and its services. ACP reserves the right to modify, suspend, discontinue, or restrict access to, all or any part of the services at any time.

Offline Browsers: In order for us to provide reliable, continuous, and timely access to Annals.org, its mobile applications, and its services for all users, we require that you configure your offline browser to request no more than one page per minute. Be aware that non-compliance with this rule will result in your access to Annals being blocked until you contact us and resolve the problem. If you repeatedly break this rule, you will be permanently blocked from the site.

Disclaimer of Warranties: In no event shall ACP or Silverchair, the hosting platform for Annals, be liable for any special, incidental, indirect, or consequential damages of any kind arising out of or in connection with the use of the articles or other material derived from Annals, whether or not advised of the possibility of damage, and on any theory of liability. Annals is provided "as is" without warranty of any kind, either expressed or implied, including, but not limited to, the implied warranties of merchantability, fitness for a particular purpose, or non-infringement. Descriptions of, or references to, products or publications does not imply endorsement of that product or publication. There is no guarantee that the information contained in the online version of the Annals is identical to the print version and neither ACP nor Silverchair has any duty to update the information contained on the online version to correct errors or otherwise.

Modifications of Conditions of Use: ACP reserves the right to modify these Conditions of Use at any time. Any such modification will be posted and the continued use of Annals.org, its mobile applications, and its services after any such posting shall constitute acceptance of the Conditions of Use as modified.

Choice of Law and Forum: Your access and use of the Services, these Conditions of Use, and all actions contemplated by these Conditions of Use, shall be governed by the laws of the United States of America and the Commonwealth of Pennsylvania and any controversy arising out of or relating to the Use or Terms of Use hereunder, shall be settled in the Pennsylvania courts and all parties shall submit to the jurisdiction of such courts.
